As no adverse submissions were received, the Draft Councillor and Staff Interaction Policy was adopted by exception.

December 2023 Update

Consultation has closed on the Draft Data Breach Response Policy, and submissions are now being reviewed. Thank you to everyone who submitted feedback.


November 2023 Consultation

Cumberland City Council is giving notification of the exhibition
of the Draft Data Breach Response Policy. This Policy will be exhibited for a period of 28 days as resolved at the 1 November 2023 Council meeting. All submissions made to this policy will be made public and considered by Council.


Policy overview

As of 22 February 2018, the Notifiable Data Breaches (NDB) scheme came into effect under the federal Privacy Act 1988 (Privacy Act). Under the NDB scheme organisations and must notify affected individuals and the Office of the Australia Information Commissioner (OAIC) when a data breach is likely to result in serious harm to an individual whose personal information has been compromised.

In addition to the NDB scheme, amendments to the Privacy and Personal Information Protection Act 1998 (PPIP Act) are effective as of 28 November 2023 creating a Mandatory Notification of Data Breach (MNDB) Scheme which requires public sector agencies bound by the PPIP Act to notify the Privacy Commissioner and affected individuals of data breaches involving personal or health information likely to result in serious harm.

The purpose of this policy is to provide a procedure detailing the key actions and responsibilities to be followed in the event of a data breach incident.

The consultation period runs from Monday 6 November 2023 to Monday 4 December 2023. During this community consultation period, residents are encouraged to submit their comments on the proposal. Anyone who wishes to provide feedback on the proposal must do so in writing by 5pm Monday 4 December 2023.
